PACT DISAPPOINTED, BUT NOT DISCOURAGED,
BY SUPREME COURT ACTION

People Against a Casino Town (PACT)

NOVEMBER 25, 2003

Florence, OR - PACT Spokesperson Arnold Buchman issued the following statement in response to the Oregon Supreme Court, today, declining to accept PACT's petition for  a writ of mandamus.

"The writ we sought would have given the Supreme Court the opportunity to rule on important constitutional challenges to the governor's authority to  allow a gambling casino near Florence. Of course, PACT is disappointed that the Court elected not to address the fundamental constitutional questions presented by the petition.

"The Supreme Court's action in no way addresses the substantive issues of this lawsuit.  Ultimately, the State will have to respond to PACT's allegations.  In petitioning the Supreme Court directly, PACT chose not to go the more usual route.  Normally, the lawsuit would have been filed in Lane County Circuit Court. We had hoped to save everyone involved - the courts, ourselves and the taxpayers - time, money and duplication of judicial effort.

"We will be meeting early next week with PACT's attorneys to finalize PACT's next actions."  said Buchman.
